Trading Conditions

These trading conditions govern reciprocal business relations between the Buyer (herein after the “Buyer“) and the operator of the internet shop www.rumebags.cz (hereinafter the “Seller“).

Buyer

Buyer - consumer - a person who does not transact within the frame of his/her own business and other activities while concluding and performing the contract. It is a physical entity or legal entity who buys products or uses services for other purposes that using these services or products for his/her own business.

At the beginning of the business relation, the consumer gives only the contact data to the seller, that are needed for trouble-free order fulfilment, and data that the Buyer wants stated on his/her purchase documentation. The legal relationship between the Seller and the consumer explicitly not covered by these general trading conditions are governed by relevant stipulation of Act No.: 40/1964 Civil Code, Act No.: 634/1992 - Consumer Protection, Act as well as related regulation, as amanded.

Consumer contract - contract of purchase, contract for work, eventually other contracts according to the Civil Code, if the contracting parties are the consumer on one hand and the supplier (seller) on the other. Buyer who is not a consumer is a businessman, who buys goods or uses services for doing his/her own business with these goods or services.

Contract of purchase - the purchase order of the Buyer is a draft contract of the purchase and the Contract of Purchase is concluded at the moment the binding agreement with draft is delivered by the Seller to the Buyer (binding confirmation of the Purchase Order on the part of the Seller). There are mutual rights and obligations from this moment between the Buyer and the Seller, that are limited by the Contract of purchase and trading Conditions.

Safety and protection of information

The Seller declares all the personal data to be confidental, that the data will be used only for the fulfilment of the contract with the Buyer and the data will not be published or passed to any other person etc. except for a situation related to the distribution or payment of the ordered goods (giving the name and delivery address). Personal data provided by the Buyer to Seller for the fulfilment of the order, are compiled, processed and maintained in harmony with current laws of the Czech Republic, particularly Act No.: 101/2000, personal data protection, as amended.

The Buyer agrees with this compiling and processing his/her personal data for the fulfilment of the subject of the contract of purchase being concluded, up to the moment of his/her written statement of disagreement with this process.The Buyer has the right to access and correct his/her personal data as well as other legal rights relevant to these data.

Purchase order of goods

The Buyer gets the goods for a price valid at the moment of placing the order.

The Buyer/Consumer has the possibility to know the total price - including VAT, before placing the order.

This price will be stated in the order form and also in the confirmation of receipt of the order of goods.

In case of special goods on order or goods out of stock, the Seller confirms the price and delivery date to the Buyer by phone or e-mail in advance.

An order can be placed by following methods:

- via e-commerce - www.rumebags.cz („e-shop“)

- via e-mail address - info@rumebags.cz, info@beebs.cz

- via telephone - phone number: + 420 734 440 434, + 420 733 600 045

The Seller recommends the Buyer to place his/her order via e-commerce or e-mail and state the following details:

- name, surname, address or company name and address

- the registration number and VAT No., if registered as a VAT payer

- the code and name of goods according to the price list

- unit price

- delivery terms

- delivery address

- other details that the Buyer considers important

Methods of payment

a) advanced bank transfer

b) by payment card (MasterCard or VisaCard)via internet payment portal

c) cash on delivery (carrier takes the money from the customer)

Transport price list - inland

a) Czech Post - registered mail - approx. 1 - 4 days (bank transfer - 50,- including VAT)

b) Czech Post - cash on delivery - approx. 1 - 4 days (price CZK 120 incl. VAT)

c) PPL - next day delivery ( price CZK 160 incl. VAT)

Transport price list - Slovakia

a) Czech Post - registered mail - approx. 5 days - price EUR10 (payment in advance to an account of Slovenská Spořitelna)

Withdrawal from the contract

The Buyer/Consumer has the right to withdraw from the contract according to Article 53 part 7 of the Civil Code, within 14 days after receiving the goods, if the contract was concluded via long distance communication. Should the consumer decide to make use of this right, he/she must deliver the withdrawal from the contract to the Seller on the 14th day from receiving the goods at the latest

The Buyer/Consumer is obliged to return the goods complete, with complete documentation, undamaged, clean, including the original packing, in the same quality and value as he/she received it. Should the return goods be incomplete or damaged the Seller can reduce price by the relevant amount (in harmony with Article 458 part 1 of the Civil Code).

The Seller is responsible for defects to the goods that will occure within the warranty period.

The warranty does not apply to common wear and tear due to normal use.

Shorter service life of goods, in view of mentioned wear and tear caused by nomal use, cannot be considered a defect and this will be taken into consideration in eventual warranty claim.

The Money for the returned goods will be returned to the Buyer/Consumer within 30 days from the withdrawal from the contract by the Buyer.

Warranty conditions

Warranty conditions are governed by the claim rules of the Seller and by applicable legislaton of the Czech Republic. The Purchase document serves as a certificate of waranty.

The warranty period for all goods is 24 months.

These general Sales Conditions are valid from 1st October 2009. The Seller reserves the right to change these general sales conditions without previous notifica
